Terms of service

1. Agreement to terms

By accessing or using Kodo Bot's products and services, including our Discord bot, the web application at https://kodobot.xyz/ and related offerings (collectively, the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

2. The service

Kodo Bot provides a multi-tenant Discord bot platform for collectible card experiences with a web dashboard for configuration and management. Features may evolve over time. We may add, modify or remove features.

Certain features may be offered as paid subscriptions or plans as described on the site.

3. Accounts and security

• You are responsible for your account credentials and for all activity under your account.
• Notify us promptly at legal@kodobot.xyz of any suspected unauthorized use or security incident.
• We may suspend or terminate accounts for violation of these Terms or our policies.

4. Acceptable use

• Comply with applicable laws and Discord's Terms and policies.
• Do not abuse, harass or harm others. Do not transmit spam or malware.
• Do not interfere with or disrupt the Service or our infrastructure.
• Do not reverse engineer, decompile or attempt to access non-public areas.
• Do not misuse currencies, rewards, drops, cooldowns or game mechanics to exploit the system.
• Do not use alternate accounts, multiple accounts or shared accounts to bypass limits, farm rewards, manipulate drops, evade enforcement or gain an unfair advantage.
• Do not copy, steal, upload, redistribute, sell or use artwork, templates, card designs, branding, code or other creative work created by another person, server, bot or community without their explicit permission.
• Do not falsely claim ownership of another person's, server's, bot's or community's artwork, templates, card designs, branding, code or other creative work.

5. Your content

You retain rights to content you submit. You grant Kodo Bot a non-exclusive, worldwide, royalty-free license to host, store, reproduce and display your content solely to operate and improve the Service. You represent that you have the necessary rights, licenses and permissions to the content you submit, upload or use through the Service, including artwork, templates, card designs, branding, code or other creative work. You also represent that such content does not infringe, misappropriate or violate the rights of any third party.

6. Intellectual property

The Service, including software, UI, text, graphics, logos and trademarks, is owned by Kodo Bot or its licensors and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute or create derivative works based on the Service.

7. Plans, billing and refunds

• Paid features, if any, are billed per the plan descriptions. Prices may change with notice.
• Taxes, where applicable, are your responsibility.
• Unless required by law or stated otherwise, fees are non-refundable.

8. Third-party services

The Service integrates with third parties such as Discord, MongoDB Atlas, UploadThing and Vercel. Your use of third-party services is subject to their terms and policies. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Kodo Bot does not warrant that the Service will be uninterrupted, secure or error-free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kodo Bot AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR ANY LOSS OF PROFITS, REVENUES, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR THE SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to indemnify and hold Kodo Bot harmless from any claims, liabilities, damages, losses and expenses arising from your use of the Service or violation of these Terms, to the extent permitted by law.

12. Suspension and termination

We may suspend or terminate the Service or your access at any time for conduct that we believe violates these Terms or is otherwise harmful. This includes using alternate or multiple accounts to exploit the Service, stealing or using another person's creative work without permission, falsely claiming ownership of another person's work or repeated violations after a warning. You may stop using the Service at any time. Some provisions survive termination.

13. Governing law and venue

These Terms are governed by applicable laws in your place of residence or our place of business, without regard to conflict of law principles. Where permitted, disputes will be resolved in the courts with jurisdiction over our principal place of business.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will post the updated Terms with an effective date. Your continued use of the Service after changes become effective constitutes acceptance.
